1.1 "Web App" refers to the EKKO.my web application developed by the Developer.

1.2 "Vendor" refers to individuals or businesses who list and sell their products through the Web App.

1.3 "User" refers to individuals who browse, search, and interact with the Web App to find products.

1.4 "Physical Store" refers to the brick-and-mortar location where the vendor's products are available for purchase.

1.5 "Stock Count" refers to the real-time availability of products as updated by the vendor.

2.1 In order to access and utilise the features and services provided by the Web App, users must create an account. During registration, users agree to provide accurate, current, and complete information, including their names, email addresses, phone numbers, and any other required details.

2.2 Users are solely responsible for maintaining the confidentiality of their account information, including their username, password, and any other login credentials associated with their account. Users agree to notify the Developer immediately of any unauthorised use of their account or any other breach of security.

2.3 By registering an account, users consent to receive communications, including promotional messages, via email or SMS, related to the Web App and its services.

2.4 Users understand that providing accurate and up-to-date contact information is essential for effective communication and delivery of relevant notifications from the Web App.

3.1 Vendors who wish to list and sell their products through the Web App must complete the vendor setup process. This includes providing accurate and complete information about their shop location, available stock, contact details, and any other required credentials.

3.2 Vendors are responsible for ensuring the accuracy and availability of their product listings, including stock counts. Vendors must promptly update stock information to reflect real-time availability as accurately as possible.

3.3 Vendors understand that the product listings provided through the Web App are subject to review by the Developer. The Developer reserves the right to edit or remove any vendor listings or shop information that violate this Agreement or are deemed inappropriate, misleading, or unlawful.

3.4 Vendors understand that they are solely responsible for complying with all applicable laws and regulations regarding their products, including but not limited to product quality, safety, labelling , and legal requirements for selling.

4.1 Users agree to use the Web App solely for personal and non-commercial purposes, in compliance with all applicable laws and regulations.

4.2 Users shall not engage in any activities that may disrupt or interfere with the proper functioning of the Web App, including but not limited to distributing viruses, spamming, or attempting to gain unauthorised access to other users' accounts.

4.3 Users understand that the location information provided by vendors is for informational purposes only and agree to exercise caution and common sense when visiting physical stores based on such information.

4.4 Users agree to use the Web App in a manner that respects the rights of vendors and other users, refraining from any abusive, offensive, or inappropriate behavior.

5.1 The Developer retains all rights, title, and interest in and to the Web App, including all intellectual property rights. Users and vendors shall not copy, modify, distribute, or reverse engineer the Web App or any of its components.

5.2 Users and vendors shall not use any trademarks, logos, or other proprietary information of the Developer without prior written permission.

6.1 The collection, storage, and use of personal information, including names, email addresses, phone numbers, and other data provided during registration, are subject to the Web App's Privacy Policy. Users and vendors agree to the collection and processing of their personal information in accordance with the Privacy Policy.

6.2 Users and vendors understand that their personal information may be used to provide personalised services, improve the Web App, and communicate important updates or promotional messages related to the Web App and its services.

7.1 The Web App is provided on an "as-is" and "as available" basis. The Developer makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or availability of the Web App.

7.2 The Developer disclaims any responsibility for any harm resulting from the use of the Web App, including but not limited to damages for lost profits, data loss, or any other consequential or incidental damages.

7.3 The Developer does not guarantee the accuracy, completeness, reliability, or timeliness of the product listings, stock counts, or other information provided by vendors through the Web App.

8.1 To the maximum extent permitted by law, the Developer shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with the use of the Web App.

8.2 Users and vendors understand and acknowledge that the Vendor's products, services, and transactions facilitated through the Web App are the sole responsibility of the respective Vendor. The Developer is not a party to such transactions and shall not be held liable for any issues arising from them.

9.1 The Developer reserves the right to suspend or terminate access to the Web App at any time, without prior notice, for any reason or no reason, including but not limited to a violation of this Agreement.

10.1 The Developer reserves the right to modify this Agreement at any time. Users and vendors will be notified of any changes through the Web App or via email.

10.2 By continuing to use the Web App after the modifications have been made, users and vendors agree to be bound by the updated terms and conditions.

11.1 This Agreement shall be governed by and construed in accordance with the laws of MALAYSIA. Any disputes arising from or relating to this Agreement or the use of the Web App shall be subject to the exclusive jurisdiction of the courts located in MALAYSIA.
